Legal Obligations for WiFi Hotspot Providers

The French law for confidence in the digital economy of June 21, 2004 (LCEN) and Article L.34-1 of the Postal and Electronic Communications Code (CPCE), as amended by the law of January 23, 2006 on the fight against terrorism, requires ISPs and all persons who, in the course of a professional activity, offer the public a connection enabling online communication — including free of charge — to retain data of a nature likely to enable the identification of anyone who has contributed to the creation of the content of the services.

This applies to hotels, restaurants, shops, town halls, marinas, airports, guesthouses, bars, cafés, schools and businesses offering visitor access.

Penalties: any failure to comply exposes the person to one year’s imprisonment and a €75,000 fine for individuals, and €375,000 for legal entities (Article L.39-3 of the CPCE).
